§ 5-1. Definitions.

  • For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning:

    Alcoholic beverages shall mean distilled spirits and all beverages containing one-half of one percent or more alcohol by volume, including but not limited to all beers, wines and malt beverages. The percentage of alcohol by volume shall be determined by measuring the volume of the standard ethyl alcohol in the beverage and comparing it with the volume of the remainder of the ingredients as though said remainder ingredients were distilled water.

    Applicant shall mean any person or entity that applies for a BTR within the town.

    Bona fide meal shall include:

    (1)

    Entree, beverage and side dish (including salad or vegetable), or

    (2)

    Sandwich and beverage.

    Business tax receipt ("BTR") shall mean the document that is issued by the town which bears the words "local business tax receipt" and evidences that the person or entity whose name the document is issued has complied with the provisions of the Town Code relating to the business tax and the Florida Statutes.

    Consumption on premises shall mean consumption of all alcoholic beverages of every kind or the right to sell by the drink, bottle or can, such alcoholic beverages for consumption on the permitted premises only.

    Live entertainment shall mean any performance by living persons including but not limited to rock music festivals, concerts, nightclub shows, plays, dinner club shows, bands, live dancing, singers, mud wrestling and any other performances which may be reasonably deemed to be and constitute live entertainment.

    Loiter shall mean to stand around or move slowly about, to spend time idly, to linger, and/or to delay.

    Person or vendor shall include all persons selling, offering or keeping, with the intention of selling or dealing in, alcoholic beverages and shall include individuals of either or both genders, corporations, partnerships or any and all other forms of legal entities as defined by and recognized under Florida law.

    Public food service establishment shall mean every building or portion of a building that is maintained and operated as a place where food and/or drink is regularly prepared, served and/or sold to the public for human consumption, including, but not limited to, any restaurant, cafeteria, lunch room, lunch counter, soda fountain, food service establishment, food processing plant or food outlet.
