§ 47-31. Operation requirements.

  • All persons engaged in the business of operating trash dumps or sanitary landfills within the corporate limits of the town shall:

    (1)

    Have available during all periods of dumping a bulldozer with operator.

    (2)

    Have a person on the premises in charge of the disposal area at all times that the premises are open for dumping operations.

    (3)

    Provide a "No Smoking" sign at the entrance to the premises.

    (4)

    Not dump or allow to be dumped any flammable liquid on the premises.

    (5)

    Not burn any materials of any nature on the premises.

    (6)

    Have a telephone available to the attendant or attendants on the premises, which telephone may be on or off the premises, with a fire department emergency phone number posted on such telephone.

    (7)

    Report immediately to the Police Department all fires which may occur on the premises of the trash dump or sanitary landfill.

    (8)

    Discontinue all dumping operations within 150 feet of a fire; and if any fire continues for a period of 24 hours, discontinue all dumping anywhere on the premises constituting the trash dump or sanitary landfill operation until the fire has been extinguished, the area of the fire inspected, and approval granted for the continuation of the dumping operations by the Fire Chief or Chief of Police of the town.

    (9)

    Allow the dumping of combustible materials only in open piles not larger than 50 feet by 100 feet, or covering an area of not more than 5,000 square feet, which piles shall be no higher than eight feet; and the piles shall be separated from each other by an open space of not less than 15 feet wide as fire corridor separations; provided, however, that the foregoing provision of this subsection (9) shall not apply to sanitary landfill operations which shall be conducted in compliance with all of the state laws, rules and regulations covering the operation of sanitary landfills.

    (10)

    Provide for the following fire extinguishing equipment and facilities:

    a.

    Either fire hydrants, or approved firewalls, or a suitable drafting site from a canal pit or lake in sufficient numbers to be reached within 300 feet of any location within the dump site area.

    b.

    A fire pump capable of taking a suction at any draft location and delivering a minimum of 500 gallons per minute at a minimum of 120 p.s.i.

    c.

    Sufficient hoses, nozzles and fittings for the control of any fire on the premises used for trash dumping or sanitary landfill operations.
