§ 38-81. Inspection and approval; compliance with technical codes; performance bond.

All residences, business buildings or other structures previously constructed outside
the territorial limits of the town, in which may reside or intend to reside persons
or animals, or which may be used or intended to be used as office buildings, or in
which materials may be placed, stored or deposited, shall be inspected and approved
by the Building Inspector of the town prior to such residences, business buildings
or structures being permitted to be moved into the town. The Building Inspector shall
determine whether or not the residences, business buildings or other structures can
be altered and/or repaired so as to comply with the town building, electrical, plumbing
and zoning codes. Upon its determination that the residences, business buildings or
other structures can be made to comply with the aforementioned conditions, the Building
Inspector shall issue a permit allowing the residence, business building or structure
to be brought into the town, provided, however, that the applicant has posted a performance
bond in an amount to be set by the Building Inspector, such amount to be not less
than $200.00 nor more than 50 percent of the value of the building as determined by
the Building Inspector. The bond shall be conditioned upon the applicant's having
satisfactorily completed the building in compliance with all of the town's building,
electrical, plumbing and zoning codes within 90 days after issuance to the applicant
of the permit. The bond shall also be conditioned upon the applicant's full satisfaction
of any and all claims for damages to the town or any property owner resulting from
the moving of any structure permitted by this article.
